These terms and conditions govern the use of this website and the provision of all the products and services offered on this website, www.shopmaternity.com.au. By using this website (whether you create an account or not), you are accepting to the terms and conditions detailed below. When you check out, you will be formally asked to acknowledge that you have read and agree to these terms and conditions.
1. SITE USAGE
You must be at least 18 years of age to use this website.
2. PRIVACY
Your privacy is always protected at Shop Maternity and we will not pass on your personal information to any third party. The information collected will be used solely to process your order and any third party involved in processing the order does not have the permission to use your information for any other purpose.
The information collected may also be used to inform you of new and additional products, services and promotions, provided that you have given permission. You can subscribe and unsubscribe to all marketing material by sending an email instruction, or by selecting the "unsubscribe" link on any of the promotional emails sent to you.
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our website.
3. COLLECTION AND USAGE OF INFORMATION
In order to use the Shop Maternity website, we may require information from you in order to provide the best service possible. All correspondence may also be collected and stored, particularly in regard to sales, support and accounts, including email.
Any information collected by Shop Maternity is collected via correspondence from you or your company. This may be via the telephone, email, mail or directly through our website.
If you purchase a product or service from us, you may be required to provide contact information (such as name, email, phone and postal address) and financial information (such as credit card number, expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you. The majority of communications is via email. Under this agreement, you agree to receive communications from Shop Maternity via email, and agree to keep your email address updated with us. It will be deemed that you have received all notices sent to your email address on file.
4. SECURITY
Security and protection of sensitive information is paramount at Shop Maternity.
Shopmaternity.com.au is a secure site using Secure Sockets Layer (SSL) to guarantee security, using an encrypted system to send credit card and billing details over the internet to our payment gateway, eWAY (which is certified to handle your card data securely). We do not store credit card details on our databases.
1. Your complete credit card number cannot be viewed by Shop Maternity or any outside party.
2. All transactions are performed under 128 Bit SSL Certificate.
3. All transaction data is encrypted for storage within eWAY’s bank-grade data centre, further protecting your credit card data.
4. eWAY is an authorised third party processor for all the major Australian banks.
5. eWAY at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by Shop Maternity.
If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, delete or deactivate it by emailing us - see the Contact Us page.
5. MODIFICATIONS TO TERMS AND CONDITIONS
Shop Maternity reserves the right to modify the terms and conditions. Upon notification to you, Shop Maternity can modify or terminate our terms of service and you agree to accept the changes. If you do not agree to the modifications in the terms and conditions (as detailed in the “latest modifications” section of the bottom of this page), please return all outstanding items and close your account within 14 days of notice, by emailing info@shopmaternity.com.au.
6. PURCHASING RETAIL PRODUCTS
Shop Maternity reserves the right to reject an order for any reason, verify the credit card information with the customer or cancel the order altogether. The product prices may also change at any time.
Orders can only be made online through the website and payment can only be taken by Visa and Mastercard Debit or Credit cards. Coupon/voucher codes are accepted and applied to your shopping cart before shipping costs are calculated.
After placing an order, a confirmation email will be sent. Once the order is dispatched, another email confirming the dispatch and tracking number (if applicable) will be sent. Please see our shipping policy below, which outlines our commitment to delivering your package in a timely manner.

7. HIRING PRODUCTS
Shop Maternity allows registered customers to hire maternity products on this website in accordance with the Terms and Conditions laid out in this section 7. Hiring Products. The customer may hire available products that deemed available by the website, however, Shop Maternity reserves the right to limit the number of products hired by one customer at any one time.
The hire period is 4 nights and starts on the day that the customer receives the product/s. After 4 nights, on the 5th day (or the next business day, should the 5th day fall on a weekend or public holiday) the hired product/s must be returned to Shop Maternity.
7.1. THREE OPTIONS TO HIRING MATERNITY PRODUCTS
Depending on the intended hire use date, the customer can check out a hire in one of three ways.
7.1.1. HIRE IT NOW
If you proceed through checkout without specifying a reservation code, Shop Maternity will dispatch the selected product within 1 business day (given you did not select the PICK UP delivery method). Delivery times vary depending on your shipping address. Shop Maternity does not aim to deliver the product in time for your intended event and will not be liable for refunds if the package does not arrive in time. You need to time the hire so that you will receive the product in time for your intended hire use. For estimated delivery times, see “Shipping Carrier” in section 7.3.
IF the PICK UP delivery method is used, the customer needs to arrange a pick up appointment by contacting Shop Maternity.
7.1.2. “RESERVE IT” OPTION
In order to reserve a hire product for a future date, contact is first made to inform Shop Maternity of a reservation intention. The customer will be notified of availability for the desired date. If available, the customer will be given a reservation code and the hire product will be deemed to be partially reserved for 48 hours. Within that time, the customer needs to proceed through checkout using the “RESERVE IT” option on the hire product (the reservation code must be entered at checkout as well) and pay for the hire to confirm and fully reserve the product. When the reserved event date nears, Shop Maternity will aim to dispatch so that the product arrives at the customer 2 to 3 nights in advance of the customer’s event date.
Reservations may be cancelled outside of 5 business days prior to the reserved date for the hire product, for a full refund. If cancelling within 5 business days, a partial 80% refund is applicable, unless the item has already been dispatched. If the hire product is already dispatched, the reservation/order cannot be cancelled.
7.1.3. “TRY IT ON” OPTION
The “TRY IT ON” option applies if the desired event date / reservation date is sufficiently far away, as deemed by Shop Maternity. It offers the customer the option to try on the hire product before actually hiring it. This option includes the return shipping for the try on exercise and the full reservation of the hire product. The price of this option is simply the hire price (same price to reserve the product), plus the cost of return shipping for the try on exercise. All the terms related to the RESERVE IT option outlined in 7.1.2 applies. The extra service offered to try the dress on at an earlier date (before the event date of the intended hire) additionally involves the confirmation of such a try on date. The checkout process and usage of the reservation code remains the same.
The TRY IT ON reservation may be cancelled outside of 5 business days prior to the confirmed try on date for a full refund. If cancelling within 5 business days of the try-on date, a partial 80% refund is applicable, unless the item has already been dispatched. If the hire product is already dispatched, or the dress is unsuitable or does not fit well and you want to cancel the reservation, you may do so. The refund policy for reservations outlined in 7.1.2 is applicable.
The try on period is 1 night, therefore, the hire product must be returned the next day. The terms and conditions detailed in 7.5 around loss, damage, theft or delayed return also applies to the try on period.
7.2. INCLUSIONS IN HIRE PRICE
The hire price / reservation price includes 4 nights hire of the product. Any shipping requirements to the customer and back to Shop Maternity depends on the delivery method chosen and is over and above the hire price.
7.3. SHIPPING CARRIER
Shop Maternity uses a courier to deliver the hired product/s to you. You will need to personally sign for the package. The delivery time is 1 to 2 days for metropolitan destinations in all states except Tasmania. For all other destinations, the delivery time is approximately 2 to 4 business days.
7.4. HIRE EXTENSIONS
Once the hire product is dispatched to you or during its hire term, you may extend the hire for another hire period (4 nights) for a nominal fee. Extensions can be arranged by phone or email. Shop Maternity reserves the right to refuse extension for any reason. (One reason might be a reservation by another customer for the same hire product).
7.5. LOSS, DAMAGE, THEFT OR DEALYED RETURNS
If a customer returns a hire product damaged or in a condition that exceeds normal wear and tear, as determined by Shop Maternity in its sole discretion, the customer agrees that Shop Maternity may charge the customer’s credit card and collect a replacement fee for such product. The product replacement is the Recommended Retail Price (RRP) disclosed on the hire product’s webpage. Before charging the replacement fee, Shop Maternity will try its best to repair the product and avoid replacement.
The customer agrees to return all rented products on time, meaning the customer will place the rented products(s) in the provided pre-labeled return bag and drop it in the Australia Post yellow Express Post sidewalk bins on or before the Hire End Date (the business day after the 4 nights of hire). The “Hire End Date” is printed on the cover letter the customer receives with each order of rented item(s). Shop Maternity will be able to track the parcel to check the date and time of product return. If the customer does not return a rented product on time, the customer agrees that Shop Maternity will charge the customer’s credit card $20 per day late fee per hired product until the return parcel is lodged at Australia Post to be shipped back to Shop Maternity.
In the event of theft or loss, the customer must notify Shop Maternity in order to avoid late return fees. Shop Maternity may charge the customer’s credit card to collect the lost/stolen product’s replacement fee.
